In addition to being next to seats people often toss them on the floors of buses and Max trains. I’ve also seen people toss them everywhere while waiting at bus and Max stops.

Talk to the operator first, that should solve the problem.
Only after you have talked to the operator should you call the company.
If your vehicle is not moving there is no problem, however, it appears that public hysteria is creating a no cell phone use at all unless your at a layover.
The unfortunate stupidity of all this is that plenty of the on board radios don’t work which means if something happens and you do not have a cell phone, you dead in the water.
Operators just need to make sure they are not operating the vehicle when using cell phones, texting or talking.
However, the greatest threat to the public comes from people in their private vehicles texting and/or driving, not from operators of public transport.
To fix the problem properly, end cell phone us while driving a vehicle, all vehicles, not just the easy targets.
